Privacy Notice for Employment Applicants, Employees, and Independent Contractors

Under certain requirements that Vacasa is subject to, including but not limited to the California Consumer Privacy Act of 2018, as amended (“CCPA”), Vacasa is required to notify you about the personal information Vacasa collects and uses in connection with your employment, application for employment, or independent contractor relationship. For purposes of this notice, “Vacasa” means Vacasa LLC and its subsidiaries and affiliates. Vacasa collects and uses the following categories of personal information.

  • Contact and personal information, including name, email address, phone number, and additional personal information disclosed in response to an advertisement and/or through submission of a job application, such as home address, educational information, and work history. Vacasa may also collect additional personal information from your social media profile, such as your LinkedIn profile and/or your personal website, plus additional contact information such as emergency contact information and dependent contact information.
  • Background information, including resume, letters of recommendation, and information needed to perform a background check, or information discovered during a background check.
  • Governmental identifiers, including passport number, national identification number, work permit, social security number, driver’s license number, or any other government identification number.
  • Employment information, including application for employment, offer letters, transition notices, job title, performance evaluations, time records, time-off or leave records, training records, disciplinary records, vehicle details, photographs, policy acknowledgements, agreements, and any personal information you input on Vacasa property.
  • Financial information, including bank account details, salary, bonuses, compensation plans, tax information, retirement account information, and any other information required to administer payroll, taxes, expense reimbursements, and benefits.
  • Electronic systems information, including systems access records, geolocation data, IP addresses, browsing or search history, and electronic communications/content created, stored, or transmitted on Vacasa property or a Vacasa system. Vacasa may use third-party software in conjunction with Vacasa-issued electronic devices, such as cell phones and laptops. The information processed by such software may be processed by Vacasa and/or the third party developer.
  • Other personal information, including date of birth, veteran status, citizenship status, preferred language, preferred names, gender, marital status, birthdate, racial/ethnic origin, medical information, and workers compensation information.

Vacasa collects and uses the information described above only for business purposes in relation to your employment, application for employment, or independent contractor relationship. Such purposes may include, as applicable:

  • To evaluate an applicant’s job application and suitability for employment with Vacasa
  • To fulfill/manage the terms and conditions of an employee relationship with Vacasa
  • To fulfill/manage the terms and conditions of an independent contractor relationship with Vacasa
  • To maintain information regarding employee work history
  • To detect security incidents and protect against malicious, deceptive, and fraudulent activity
  • To ensure compliance with Vacasa policies and to comply with legal requirements, including but not limited to, record retention requirements and conducting OFAC screenings, and to assist Vacasa in the defense of legal claims

Vacasa retains your personal information for as long as reasonably necessary to fulfill the purpose(s) for which Vacasa collected such information as described in this notice, or for as long as Vacasa is legally required to retain such information under applicable law. Vacasa may process your information after your employment concludes or contractual relationship ends in order to investigate potential violations of law; respond to lawfully-issued subpoenas and other requests for information; comply with reporting and recordkeeping requirements; and/or prosecute or defend against any legal claims or actions, whether potential, threatened, or actual. Vacasa maintains a variety of organizational and technical measures to protect against unauthorized or unlawful processing, as well as against accidental loss, destruction, or damage.

Vacasa does not sell or market your personal information. Vacasa may share your personal information with third parties (including Service Providers, as such term is defined under the CCPA) to: (a) facilitate one or more uses identified above, (b) facilitate a sale, assignment or transfer of all of part of Vacasa’s business, or (c) comply with other legal requirements. Bajo ciertos requisitos a los que Vacasa está sujeta; incluyendo, pero no limitados a la Ley de Privacidad del Consumidor de California de 2018, en su forma enmendada (“CCPA”), Vacasa debe notificarle sobre la información personal que recopila y usa en relación con su empleo, solicitud de empleo, o relación de contratista independiente.   • Información financiera, la cual incluye los detalles de la cuenta bancaria, sueldo, bonificaciones, planes de compensación, información tributaria, información de la cuenta de jubilación y cualquier otra información necesaria para administrar las nóminas, impuestos, reembolsos de gastos y beneficios.
  • Información de sistemas electrónicos, los cuales incluyen los registros de acceso a los sistemas, datos de geolocalización, direcciones IP, historial de búsqueda o navegación, y las comunicaciones/contenidos electrónicos creados, almacenados o transmitidos en propiedad de Vacasa o en un sistema de Vacasa. Vacasa puede usar software de terceros junto con dispositivos electrónicos entregados por Vacasa como teléfonos celulares y computadores portátiles. La información procesada por dicho software puede ser procesada por Vacasa y/o el desarrollador externo.
  • Otra información personal, la cual incluye fecha de nacimiento, condición como veterano, estado de ciudadanía, idioma preferido, nombres preferidos, género, estado civil, origen racial/étnico, información médica e información sobre compensaciones laborales.

Vacasa recopila y utiliza la información descrita anteriormente solo para fines comerciales en relación con su empleo, postulación de empleo o relación como contratista independiente. Dichos propósitos pueden incluir, según corresponda:

  • Para evaluar la postulación de empleo de un solicitante y su idoneidad para trabajar con Vacasa.
  • Para cumplir/gestionar los términos y condiciones de una relación laboral con Vacasa.
  • Para cumplir/gestionar los términos y condiciones de una relación laboral de un contratista independiente con Vacasa.
  • Para almacenar información sobre el historial laboral de los empleados.
  • Para detectar incidentes de seguridad y protegerse contra actividades maliciosas, engañosas y fraudulentas.

Privacy Notice for Employment Applicants, Employees, and Independent Contractors (Canada)

Under Canadian privacy law, including but not limited to the British Columbia Personal Information Protection Act (BC PIPA), the Ontario Working for Workers Act 2022, and general principles of privacy law, Vacasa is required to notify you about the personal information Vacasa collects and uses in connection with your employment, application for employment, or independent contractor relationship in Canada. For purposes of this notice, “Vacasa” means Vacasa LLC and its subsidiaries and affiliates.

Vacasa collects and uses the following categories of personal information:

  • Contact and personal information, including name, email address, phone number, and additional personal information disclosed in response to an advertisement and/or through submission of a job application, such as home or mailing address, educational information, and work history. Vacasa may also collect additional personal information from your publicly available social media profile, such as your LinkedIn profile and/or your personal website, plus additional contact information such as emergency contact information and spouse and dependent contact information.
  • Background information, including resume, letters of recommendation, and information needed to perform a background check, or information discovered during a background check.
  • Governmental identifiers necessary to perform your duties through your employment or contract with Vacasa, including national identification number, work permit, social information number (SIN), passport numbers, driver's license number, or any other necessary government identification number.
  • Employment information, including application for employment, offer letters, transition notices, job title, performance evaluations, time records, time-off or leave records, training records, disciplinary records, vehicle details, photographs, policy acknowledgments, agreements, union affiliation, and any personal information you input on Vacasa property.
  • Financial information, including bank account details, salary, bonuses, compensation plans, tax information, retirement account information, and any other information required to administer payroll, taxes, expense reimbursements, and benefits.
  • Your use of Vacasa electronic systems to ensure systems’ integrity and protection of confidential information, including systems access records, geolocation data, IP addresses, browsing or search history, and electronic communications/content created, stored, or transmitted on Vacasa property or a Vacasa system.
  • Vacasa may use third-party software in conjunction with Vacasa-issued electronic devices, such as cell phones and laptops. The information processed by such software may be processed by Vacasa and/or the third-party developer.
  • Other personal information, where it is necessary in the context of your employment or contract, including date of birth, citizenship status, preferred language, preferred names, gender, marital status, birthdate, medical information and workers compensation information.
  • When you download/access the FieldApp, Vacasa collects your email, the start and end time of any cleans performed, work profile, cleanliness score from customers, as well as app performance analytics data including IP address, device ID and operating system used. If you are an employee, or an independent contractor directly engaged by Vacasa, we also collect your name.

Vacasa collects and uses the information described above only for business purposes in relation to your employment, application for employment, or independent contractor relationship. Such purposes may include, as applicable:

  • To evaluate an applicant's job application and suitability for employment with Vacasa.
  • To fulfill/manage the terms and conditions of an employee relationship with Vacasa.
  • To fulfill/manage the terms and conditions of an independent contractor relationship with Vacasa.
  • To maintain information regarding employee work history.
  • To detect security incidents and protect against malicious, deceptive, and fraudulent activity.
  • To ensure compliance with Vacasa policies and to comply with legal requirements, including but not limited to record retention requirements, conducting sanction list screenings, and to assist Vacasa in the defense of legal claims.
  • In case of the Field App, to manage our cleaning operations and rental readiness, to ensure rental cleanliness, to assess the performance of our employees and contractors, to access and optimize the Field App performance, and to prevent security threats. Contractors can choose to use the information in the Field App to assess their own employees.

Vacasa retains your personal information for as long as reasonably necessary to fulfill the purpose(s) for which Vacasa collected such information as described in this notice, or for as long as Vacasa is legally required to retain such information under applicable law:

  • Personal information submitted in support of an application for employment becomes part of your personnel file if you are hired.
  • Vacasa may process your information after your employment concludes or contractual relationship ends in order to:
    • investigate potential violations of law;
    • respond to legally-issued subpoenas and other requests for information;
    • comply with reporting and recordkeeping legal requirements;
    • and/or prosecute or defend against any legal claims or actions, whether potential, threatened, or actual.

Vacasa maintains a variety of organizational and technical measures to protect it against unauthorized or unlawful processing, as well as against accidental loss, destruction, or damage.

Vacasa does not sell or market your personal information.

Within Vacasa, your personal information is only accessed by employees who have a need to know in the course of their duties.

Vacasa may share your personal information, in relation to your employment, contract or application, with third parties including Service Providers, defined as any person or organization that processes personal information on behalf of Vacasa in the context of a service agreement, to: (a) facilitate one or more uses identified above, (b) facilitate a sale, assignment or transfer of all of part of Vacasa's business, or (c) comply with other legal requirements.

Your personal information may be stored in Canada, the U.S. or in another country.

You may have certain rights with respect to accessing and controlling your personal information, including rights concerning the collection, use, and sharing of your data. To the extent that we are legally or otherwise obligated to fulfill one or more of the following requests on the basis of your legal right(s) to cause us to do so, you may exercise any of the rights described in this section by submitting a request through our Data Request Form, if applicable, or via privacy-canada@vacasa.com.

  • Update your personal information. You may ask us to correct inaccurate or incomplete personal information about you.
  • Right to access your personal information. You have the right to obtain a copy of your personal information in our possession. You may also have the rights to request a copy of personal information that you provided to us in machine-readable form, and to request that we transfer this information to another Service Provider if technically feasible to do so. We will respond within the timeline required by applicable law either to provide you access to your personal information or to ask for an extension if it is necessary to retrieve it or to provide reasons in case we are precluded from providing it. For example, we could not provide you access to your personal information if doing so revealed someone else’s personal information without consent.
  • Right to request deletion of your data. Under certain circumstances, you may have the right to ask us to erase or delete some or all of your personal information.
  • Right to object to, withdraw consent to, or limit use of your information. You have the right to ask us to stop using some or all of your personal information for certain purposes if our processing of your information is based on legitimate interests. In such cases, we will no longer use your personal information for such purposes unless: (i) our use is required to establish, exercise, or defend legal claims or (ii) we demonstrate compelling legitimate grounds for our use of the information. If our use of your personal information is based on your consent, you may withdraw your consent at any time by sending a request stating what consent you are withdrawing. Any withdrawal of consent is prospective only (meaning it does not apply to our use of your data before we receive the withdrawal).
  • You may also have the right to limit the ways we use your personal information, especially if the information is inaccurate or our use of the data is unlawful.
  • Right to file a complaint with a supervisory authority. You have the right to file complaints about our information processing activities with the relevant data protection authority. In British Columbia, the data protection authority is the Office of the Information and Privacy Commissioner and in Ontario, it is the Office of the Privacy Commissioner of Canada.
